2. Our Terms and Conditions (“Terms and Conditions”) cover the purchasing of solutions (purchase of hardware and software items) on our website.
3. These Terms and Conditions are binding on anyone clicking on any page or simply browsing on the website.
4. Tycom allows for the involvement of approved third party organisations being our reseller partners throughout Africa and these partners will assist with delivery and installation.

3. Consumer Notice

1. Tycom recognises that users within the Replublic of South Africa are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”).
2. These Terms and Conditions contain provisions that appear in similar text and style to this clause and which -1. may limit the risk or liability of Tycom or a third party; and/or
   2. may create risk or liability for the user; and/or
   3. may compel the user to indemnify Tycom or a third party; and/or
   4. serves as an acknowledgement, by the user, of a fact.
3. It is your responsibility as a user read and to understand these Terms & Conditions. If you don’t understand a clause, please contact Tycom directly and request clarification.
4. Users should only access Tycom if they agree with the Terms and Conditions. If users continue to browse and purchase on the Tycom Website then it is deemed that have read and accepted the Terms and Conditions as stipulated on the website.
5. Tycom permits the use of this Website subject to the Terms and Conditions. By using the website you automatically agree to the Terms and Conditions herein.
6. Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation.

6. Conclusion of sales and availability of stock

1. Users may place orders for solutions (i.e. hardware and software items), which Tycom may accept or reject. We will attempt to maintain sufficient stock levels to cater for purchases, however, should items be out of stock, a Tycom representative will be in touch and contact the user with an expected time of arrival for particular item or stock ordered. note that if we do not have the stock as suggested we will be in touch with an expected time of arrival of the stock. If the expected delivery date does not meet with your expectations, the user may request a full refund. Refunds will only processed and paid to user/person/entity whom placed the order and where stock is not available within a reasonable period. NO PAYMENTS TO THIRD PARTIES WILL BE PROCESSED. All refunds will be subject to the submission of the requested refund documentation and these refunds will be processed within a reasonable period.In normal circumstances a sale is not subject for a refund after the user does the online purchase. It is expected that you are fully aware of what you are purchasing, and a return will not be processed due to you not understanding the technical specifications of the solution. Please contact us before you purchase if you need guidance.
2. NOTE: Tycom considers the sale processed by delivering the solutions to you or allowing you to collect them at which point we consider it an agreement of sale between you and Tycom.
3. Placing product in the shopping basket does not mean they are ordered.
4. Pricing may change at any time.

 

7. Payment

1. We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
2. Payment can be made for Solutions via -1. debit card;
   2. credit card: where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the Goods. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;
   3. direct bank deposit or electronic funds transfer: if you pay via direct bank deposit or electronic funds transfer, payment must be made within 5 (five) days of placing your order. Tycom will not accept your order if payment has not been received;

3. Once you have selected your payment method (save for cash on delivery or direct bank deposit), you will be directed to a link to a secure site for payment of the applicable purchase price for the Goods.

 

8. Delivery of product

1. Tycom offers 2 methods of delivery. You may elect delivery via:1. courier; or
   2. self-collection.
2. Where it accepts your order, Tycom or the a Third Party Partner will deliver the Goods to you as soon as reasonably possible.
3. Tycom’s obligation to deliver an order to you is completed when we deliver the order to the physical address nominated by you for delivery of the order. Tycom is not responsible for any unauthorized use or loss of a product once delivered.

 

9. Eroneous Information

1. We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of solutions on the Website. However, should there be any errors of whatever nature on the Website we will not accept liability for any loss unless there is gross negligence on our part.

 

10. Promotions

1. Only one promotion can be selected per purchase.

      3. Tycom does not accept liability for any loss through a connection to Tycom’s Website.
      4. All warrantees are subject to the original equipment manufacturer warrantees. Tycom does not accept liability outside of these warrantees.

 

16. Jurisdiction

These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.
      2. In the event of any dispute arising between you and Tycom, you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Pretoria).
      3. Nothing in this clause 23 or the Terms and Conditions limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA.

      2. Notices must be sent through the following methods. All notices sent –
         1. by prepaid registered post, will be deemed to have been received 10 days after the date of posting;
         2. by email will be deemed to have been on the date indicated in the “Read Receipt” notification. Use “read Reciept” in order to serve as proof that an email has been received.

1. 1. 1. Tycom may, in its sole discretion, at any time and for any reason and without prior written notice, suspend or terminate the operation of the Website or the user’s right to use the Website or any of its contents subject to us processing any orders then already made by you.
         1. You may not cede, assign or otherwise transfer your rights and obligations in terms of these Terms and Conditions to any third party.
         2. Any failure on the part of you or Tycom to enforce any right in terms hereof shall not constitute a waiver of that right.
         3. If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.
         4. No variation, addition, deletion, or agreed cancellation of the Terms and Conditions will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.
         5. No indulgence, extension of time, relaxation or latitude which any party (the “grantor”) may show grant or allow to the other (the “grantee”) shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.
         6. These Terms and Conditions contain the whole agreement between you and Tycom and no other warranty or undertaking is valid, unless contained in this document between the parties.
